SphereHive Projects – Terms and Conditions

Welcome to SphereHive Projects. These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “Customer”, or “Purchaser”) and SphereHive (“Company”, “we”, “our”, or “us”), governing your access to and use of our digital products, including but not limited to project files, source code, documentation, reports, and related materials (“Products”). By making a purchase or using our services, you acknowledge and agree to these Terms in full.
1. Use of Products
- 1.1 All Products are delivered in digital format and are intended solely for personal, educational, academic, and research purposes.
- 1.2 Redistribution, resale, sublicensing, publication, or representation of the Products as your original work is strictly prohibited under the Indian Copyright Act, 1957.
- 1.3 Products shall not be used for unlawful purposes, academic malpractice, or in violation of the rules and regulations of any educational institution.
- 1.4 Users are responsible for ensuring compliance with their institution’s policies regarding originality and plagiarism.
2. Payment & Access
- 2.1 Payments are processed securely through third-party payment gateways (e.g., PhonePe, Razorpay, UPI, debit/credit cards). SphereHive does not store or retain sensitive payment details, in compliance with the Information Technology Act, 2000 and applicable RBI regulations.
- 2.2 Upon successful payment confirmation, Customers will receive access to the purchased Products within 24 hours via email, download link, or customer dashboard.
- 2.3 All fees are exclusive of applicable taxes (if any) and are subject to change at the discretion of SphereHive without prior notice.
3. Intellectual Property Rights
- 3.1 All Products, content, and related intellectual property remain the sole property of SphereHive and/or their original authors and are protected under the Copyright Act, 1957.
- 3.2 Customers are granted a limited, non-exclusive, non-transferable, revocable license to use the Products for learning and personal development only.
- 3.3 Unauthorized copying, modification, or distribution of Products is a violation of Indian intellectual property laws and may result in legal action.
4. Disclaimer of Warranties
- 4.1 All Products are provided on an “as-is” basis without any express or implied warranties, including but not limited to warranties of performance, merchantability, or fitness for a particular purpose, as per the Indian Contract Act, 1872.
- 4.2 SphereHive does not guarantee academic approval, plagiarism-free acceptance, or compatibility with all systems.
- 4.3 Customers are solely responsible for the manner in which they use the Products.
5. Limitation of Liability
- 5.1 To the maximum extent permitted under the Consumer Protection Act, 2019, SphereHive shall not be liable for any: direct or indirect losses; incidental or consequential damages; loss of academic grades, reputation, data, or profits; arising from the use or misuse of our Products.
- 5.2 In no case shall SphereHive’s total liability exceed the amount paid by the Customer for the specific Product purchased.
6. Refunds & Cancellations
- 6.1 Since Products are digital in nature, refunds shall be governed by our Refund Policy.
- 6.2 Refunds may only be considered in limited circumstances such as duplicate payments or failure to receive access to the Product.
7. Governing Law & Jurisdiction
- 7.1 These Terms shall be governed by and construed in accordance with the laws of India.
- 7.2 Any disputes or claims arising out of these Terms shall fall under the exclusive jurisdiction of the competent courts in Karnataka, India.
8. Amendments
SphereHive reserves the right to modify, update, or amend these Terms at any time without prior notice. Customers are encouraged to review the Terms periodically. Continued use of our Products constitutes acceptance of the updated Terms.
